How to register an NGO under Trust Act?

Most nations in West Africa have had success with NGOs. This is because, prior to establishment, founders adhere to all regulations and guidelines for establishing an NGO in Africa. The State's Companies Act provisions should be followed during the NGO registration process.

The NGO should work for the general public with a non-profit goal or expectation from the beginning because it is a legal body. The registration processes and laws that apply to Trusts, Societies, and Companies vary from one another. According to the Trust Act, two trustees are required for any trust that is being registered. Requirements for NGO registration in West Africa

According to the Societies Registration Act, a trust or NGO must have at least seven members, and a national society, trust, or NGO must have at least eight promoters.

The Trust or NGO must be registered with the selected three alternate names for the NGO or Trust, and one of the promoters must be the authorized person. The registrar settles on the NGO's name by cross-referencing the preferred names with those of other previously registered NGOs. A Trust or NGO can be created by any individuals, partnership firms, corporations, or recognized organizations.

For the registration of an NGO, two crucial documents are needed, and they are:

  • Articles of Association

  • NGO's Rules & Regulations
     

The Articles of Association should include the following information: 

  • Proposed name of the NGO

  • the operational area of the organization

  • registered office

  • NGO objectives 

  • member and promoter names. 
     

All of the Trust's or NGO's goals and objectives that would direct the operation of the proposed Trust should be included in the Rules and Regulations. It contains information about quorum requirements for meetings, membership termination, powers and duties of office holders, bank account operations, how to dissolve or merge the organization if necessary, and other fundamental guidelines needed to run a trust or non-profit organization.

The founders of the proposed Trust or NGO should sign every page of the carefully written Rules and Regulations and Memorandum. The articles of association and Rules and Regulations must also be prepared and kept available for the registration process.

What are some of the documents required to register a charity organization in West Africa?

The required documents are different in each country, and they may also include additional documents such as financial reserves or assets.   In order to complete the NGO registration procedure, non-profit organizations will invariably be required to submit annual reports as well as financial audit reports to the appropriate local authorities and agencies.
